Germany's High Court has ruled the country's smoking ban is unlawful.

The smoking ban was introduced in Germany at the start of 2008 but is now under scrutiny after two bar owners in the states of Baden Wuerttemberg and Berlin won their case.

The German ban allows restaurants and bars in some states to have one room set aside for smoking but the court said this discriminated against one-room venues.

The two bar owners claimed takings were down 30% since the start of the ban.

The court has given states until the end of 2009 to either introduce a blanket ban or change the rules at one-room pubs and until then, smoking will be allowed in one room venues under 75 square metres.

Amazing what can be achieved when the hospitality unites and fights against this threat to trade. The Germans were also told that trade would boom post ban,.But perhaps their summers arent wet, or their supermarkets dont sell cheap booze, or there isnt a credit crunch in Germany.

Or, more likely they dont believe this garbage and recognise the real impacts of smoking bans, and do something about it.

Unfortunately the Germans will have to rely on support from their european neighbours, else the impending EU wide directive will override this ruling.

Well what are you waiting for..........

Well done germany. Lets now hope other European countries do the same. All it takes is unity within the hospitality trade. I suggest we should give support to them at EU-level as we dont want the Germans to be seen as the odd ones out with common sense!!

Absolutely amazing ! The EU brings in the smoking ban, yet in bars and restaurants around europe, especially in the med they have their own interpretations that continue to allow self policing of the smoking policies in individual establishments.

Only in good old blighty do we send out a bunch of left wing mini hitlers to enforce the rule to the letter without compromise or considerations for the effect on business. whatever happened to risk assesment, oh and whilst on the subject not only do they force disgruntled smokers outside, we the publican are responsible for those discarded dimps from any passerby if we dont sweep up a £2500 is slapped on us.

Hamburg looks good !

The International Coalition Against Prohibition Conference on the 27th - 28th January 2009 in the EU Parliament Building has now got added importance to present the truth regarding second hand smoke to each and every politician within the EU and beyond.

As has been said by other posters, unite and kick the bans into the history books where they belong.

Meanwhile Nicoderm manufacturer Johnson & Johnson Company, whose private foundation (RWJF) funded the smoking ban agenda, report an increase of 40% in 1st quarter profits." That was 2 days back. Remember also that the Nicoderm product is NOT a huge part of the sales, just the growth area. Dave E.

Even with the Germans and the Spanish leading the way and showing that things can be changed unfortunately the British licenced trade does not have the bottle to join their European counterparts. They would sooner lose their businesses and live on the dole than find the backbone to challenge this wrongfull law. Our politicians are the same type of cowards and would change policies if their jobs,as do the publicans, come under threat. But it needs the trade to unite in the fight against the erosion of civil liberties. In London the WCC banned the chinese restaurants from using their ovens to serve Peking Duck because one little Hitler on the council did not approve of the ovens used. The Chinese community opposed this ruling and shamed the council into backing down. Now we can all enjoy a bit of crispy duck because the Chinese showed the council to be "chicken"when challenged. Food for thought ?

All the evidence is around us telling our government a total ban does not work and the only way to get them to listen is to tell them you will not vote for them next time. Regardless of the political party, no politician would want to lose their cushy job in Westminster so the fight goes on and we must keep reminding these politicians right up to polling day that we won't support them, "CAN'T SMOKE, WONT VOTE".

Sean ,remember the unique position that publicans have. They meet many people in their pub and over the bar. They are in a strong position to "influence" customers to any point of view they hold.Time to "walk the walk" or may i say "talk the talk".
