Smoke ban rebel licensee Nick Hogan has lost his Crown Court appeal against convictions for flouting the smoking ban.
Hogan appealed three of his four convictions of failing to prevent people smoking at the Swan and Barristers in Bradshawgate, Bolton.
He claimed he couldn’t reasonably be expected to know people were smoking.
But his appeal was thrown out at Bolton Magistrates, meaning the original fines of between £750 and £3,000 still stand. Hogan was also ordered to pay an additional £1,000 costs.
But Judge Angela Nield pointed to Hogan’s well-publicised opposition to the ban, including a protest on the day of the ban and widespread media coverage of his views.
“He made it clear he did not intend to take any action to stop anyone smoking,” the judge told Bolton Crown Court. “This would have encouraged people to smoke on his premises.”

RE: Smoke ban rebel loses appeal This decision is flawed as third party reporting by the media cannot be used as evidence within a court of law. In addition what went on within the Swan Hotel on the 1st July again has nothing to do with the case as he was not presented with a summons covering the events of the 1st July 2007. Gordon Brown claims that he will provide a Fairer Britain... can we honsetly believe this man, go now Gordon before you are pushed out the door after the Glenrothes by-election (I know the date of this but am sworn to secrecy) but roll on the third week in November when the proverbial will hit the fan. RE: Smoke ban rebel loses appeal Hi Nick Hard luck on your recent appeal, but do not worry , help is on the way and when the next general election comes round we will see exaclty how the minority will boot Labour out of Westminster and watch over 200 Labour MPs crying in their inflated and indexed linked pensions. As your friend and mine, Bill Gibson indicates in 3 weeks time, roll on the people of Glenrothes and kick GB and his cronies where it hurts.
