A tribunal system funded by Government or a fixed cost expert referral scheme run by the BII were two solutions suggested to help tenants get a better deal at rent review time at the pubco inquiry.

Speaking at the Business and Enterprise Committee, David Morgan of Cookseys DMP and a Fair Pint founder, said there was “no transparency” in the rent review process. He claimed that pubcos hardly ever provide calculations on how they have arrived at a rental figure, leaving tenants with little chance.

Morgan said he would like to see a tribunal system set up, comprising of lawyers, accountants and surveyors, with help on costs from central Government. He also said the six recommendations made by the 2004 Trade and Industry Select Committee to the Royal Institute for Chartered Surveyors (RICS) must be included in its guidance. “We must have an absolute insistence on transparency in rent negotiations,” he said.

Martin Willis claimed to act for both tenants and Pub Co's. When did he last act for a tenant and how many has he acted for in the last ten years.

I sat next to his Chairman for lunch who claimed that his fees were £300+ an hour and similar for his senior staff, how many tenants can afford those fees. If any reader of the Forum has used his services would he please let us know and how good was he.

He is still listed as being on the RICS Valuation Committee with a whole lot of other RICS members who would appear to enjoy the major Pub Co's patronage. It makes very interesting reading, we were unable to find anyone on the Committee whose sole or major involvement was serving lessees. The Committee would appear to be totally stacked against the lessees, anyone that would like me to email the list contact me at info@buyingapub.com, I will also attach some interesting observations. It would appear that a lot of people are questioning the possible integrity of this Committee and in turn the role that the RICS has to bear in the problems generated.

The more people that question their activities the greater the chance of serious change.
