Business and Enterprise Committee chairman Peter Luff has urged the Government to give the industry until October to change following its damning report on pubco power.
Luff has written to the Minister for Further Education, Skills, Apprenticeships and Consumer Affairs Kevin Brennan asking for the Government’s response to be delayed until October as there had been “significant developments” since the report, which recommended a full Competition Commission inquiry.
“It appears likely that Camra will launch a super-complaint to the OFT, and the ALMR is working with an industry group to negotiate changes in the industry,” said Luff.
“An early Government Response would not be able to consider the outcome of these developments, and the Government might be constrained in what it said because of the reality or even the likelihood of a super-complaint.
“We would prefer to wait and see what progress is made on these developments rather than have an early and necessarily incomplete reply.”

Luff gives pub trade till October to change Mr Luff, having an accurate grasp of the situation, is being business like due to the apparent cap in handness of the pubcos. Nothing substantive will change though and that will certainly be clear by October. I really think Peter Luff has a grasp of the situation, he knows no real changed has occurred since the 04 enquiry and he has said parliament were misled and given information which is false. RE: Luff gives pub trade till October to change Unfortunately Michael this is the crux of the issue. If the tie was being operated as the experts were told TISC 2004 the revenue from the tie would have directly counter balanced the offset in rent. In 2004 they stated that the average difference between their pricing and that that a freeholder could get was £70 per BB. They stated that this sum was directly taken into account when setting out a tied rent. What they did not tell the inquiry was that due to their buying power they were actually getting £250 per BB and keeping the other money. In reality the discount a freeholder could achieve is £180 per BB so the Pubcos have been keeping this extra revenue as well. In effect a managed house would have caused you no problems as you would be getting your beer at a slight discount (from wholesale pricelist) but a much reduced rent in line with your beer volumes. You would be able to compete however as tied pubs are paying rents in line with being free of tie and then the tie on top there is no margin to be competitive. If your rent were set in line with the very spirit of the tied agreements you would have margin for movement, but not under the way that this agreement has been Frankensteined. This system is designed to get publicans money invested into properties and then get them out and keep the cycle running.
