Again from the HSE The Health and Safety at Work etc Act 1974 (HSW Act) Employers have a legal duty under this Act to ensure, so far as it reasonably practicable, the health, safety and welfare at work of their employees. The Management of Health and Safety at Work Regulations 1999 Employers must consider the risks to employees (including the risk of reasonably foreseeable violence); decide how significant these risks are; decide what to do to prevent or control the risks; and develop a clear management plan to achieve this.

Thinking about it,  Can the HSE  take the councils to court for demanding that we put ourselfs and customers in a possition of risk by Policing their law? what does the MA legal bods think?

The Health and Safety Executive (HSE) defines work-related violence as: Any incident in which a person is abused, threatened or assaulted in circumstances relating to their work This can include verbal abuse or threats as well as physical attacks. These pages explain what HSE is doing to address the issue of work related violence and provide access to a range of information. Physical attacks are obviously dangerous, but serious or persistent verbal abuse can be a significant problem too, as it can cause damage employees’ health through anxiety and stress. For their employers this can represent a real financial cost – through low staff morale and high staff turnover. This in turn can affect the confidence of a business and its profitability. Further costs may arise from expensive insurance premiums and compensation payments. All work-related violence, both verbal and physical, has serious consequences for employees and for the business they work for. i had the same Harry, three council spys admitted to drinking 5 pints of stella each in court and the judge said they did a good job. their expences for the night were £150 each which i am supposed to pay in the £10,008.00 costs. what makes it worst is i cannot afford to appeal. so much for British Justice

Isnt it about time that ALL licencees across the country got together to fight this. MA you can help to organise this as you did with Mr Darling, or have you too been surpressed by  HMG like all the other media ?????

This law is a joke.!!! how can you be stopped smoking a legal product on private property. articial 4 of the human rights act says   Article 4 Prohibition of slavery and forced labour 1 No one shall be held in slavery or servitude. 2 No one shall be required to perform forced or compulsory labour.   this ban is unlawfull and will not be policed by publicans

Why not take it further and ban all MP's that voted for an all out ban, that should start them talking.
