This is excellent news! Sky will be shaking in their boots now. Prosecutions to continue A Premier League spokesman said: "The Premier League looks forward to the free movement element of this case being clarified in the ECJ. "Publicans should not see this as an indication that the use of foreign satellite equipment in the UK has been legitimised, given that the Administrative Court in its December judgment found in favour of MPS in relation to copyright law. "Mrs Murphy’s conviction has not been overturned and still stands. "MPS will continue to investigate and take forward prosecutions in this area."   Of course the Premier League would say that to scaremonger, but ESTA will see to it that pubs will continue to fight to have their prosecutions on hold until the ECJ's hearing. I think this is just their way of throwing their dummies out of their cots because the court did not favour the case being denied a referral to the ECJ.

I agree that this could take years but pending on the decision of Karen Murphy's case and I hope her case gets referred to the ECJ too, I hope all pending prosecutions by the Premier League will be on hold until the EU Court's decision.

Thats why we are hoping that the case gets to the EU Courts for a final ruling on obtaining official viewing cards if you are outside of the territory. Whatever happens, sky will lose. If sky wins the case, they will have to make sure that none of their viewing cards are active outside of the UK. If we cannot subscribe to foreign satellites, then people in mainland europe cannot subscribe to sky. If sky lose the case,. then we will have a choice of which foreign satellites we can subscribe to and sky/FAPL cannot prosecute or dominate people into subscribing to sky.

I hope these cases gets referred to the ECJ for a final rulimg so that this issue can be resolved once and for all,.

I'm not going to court, Stefan. I'm just stating my own argument on the issue and waiting whether my argument will win when the court system has ran its course.

This is where domestic vs commercial viewing arguments come into it. With regards to foreign satellitte viewing in the UK, broadcasters currently say that they have no rights to broadcast their channels outside of their territories and neither domestic or commercial customers can subscribe to their broadcasts when they are in another country. Broadcasting companies may have a case towards commercial viewing because of possible infringement of showing programmes that viewers are not entitled to view. However, my argument is that when you are a private viewer of a subscribed satellite service no matter where it is, you are entitled to view the channels so long you are paying for the copyright to view it. Therefore it is my argument that the broadcasters contracts to restrict their channels to within their territories is an infringement of competition law and severral EU Directives. Whether my argument will win is yet to be ruled.

The broadcasters are at it again - making sure no one outside the territory has their official cards, well the French broadcaster anyway - read this - http://www.broadbandtvnews.com/?p=5087 The same ole' line - French pay-TV operator Canal+ will switch off all DTH subscribers to the channel in Switzerland and Belgium. The company wants to end this “grey market”, according to French press reports, as it does not have the rights to French speaking territories outside of mainland France. I'm getting sick of hearing about their so called no rights policies. Haven't the broadcasters heard about the TVWF policy.
