What's Brian Jacob'sbook called? I spoke to Phil Dixon today for the first time and he was very helpful. Just had an email from Punch and they are insistant that any outcome from the PIRRS scheme is confidential, and I'm adamant that it won't be - whoes right? |

Phil, I have sent you 2 numbers I can be contacted on and look forward to hearing from you shortly. One massive point for me though is the mention of confidentiality and I am totally opposed to this. If confidentiality is a pre-requisite of the system then we may have a problem as I WILL NOT agree to it. I will go further and state that whatever happens I will publish the results of my experience with PIRRS reagrdless of what the PubCo's and BII want. How can any PIRRS results be used as comparables? Where is the benefit to either the tenants or the system in results being confidential? Surely there are massive benefits in all details of every case using PIRRS being in the public domain - if rent review decisions start going in the favour of the tenants then the PubCo's might actually stop wasting everybody's time and seek reasonable rents at the review? If the rent review decisions carry on being rubber-stamped for the PubCo's then all tenants will know that nothing has changed and now is the time for more direct action, and don't bother wasting £1500 on it? |

We have live singers and duo's on about every 3 or 4 weeks, it certainly up's the night's takings but when you pay betwen £150 and £200 for the act, add on extra staff there's not much extra taken. Being a village pub we see it as part of providing a service to our local's. None of them believe that though!!! |

Rent review date is 25th January, so can't really wait any longer! I'm gonna try and get both sides to agree to revisit once the RICS makes a final statement but what do you think the chances are? Anyway, we're going into this with a positive outlook and we'll see what happens. |

Thanks for all the advice which I am taking on board and will be getting in touch with the people who have offered help over the next day or so - a couple of points. As ours is a rent review I've been advised that court isn't an option - it's either PIRRS or the old method of £500 per hour RICS 'expert'. I actually want to use PIRRS and document how it plays out, come on MA and BII here's an opportunity to show everyone how fair and transparent the system is going to be! The list of possible 'experts' is on the www.pirrscheme.com website and I intend to narrow the choice down over the next day or so and call all the possibilities personally to discuss their position on the prime principle. Karl Harrison, thanks for the advice - thats how I saw it but Punch are trying to say "we're waiting for more guidance" before we act. Anyway, with our passing rent it will cost us £1500 to go ahead with PIRRS and unless Punch accept our offer before close of play tomorrow that's where we're going, I will keep you all informed but if it gets boring for you please let me know and I'll stop. michaelrounthwaite@hotmail.com Thanks Michael The Royal Oak North Leverton |

Well I had a meeting yesterday with one of Punch's surveyors and member of RICS RE: our rent review and he refused to accept that the so called 'prime principle' had any relevance whatsoever. He maintains that the preceding sentence saying the rent will be reviewed purely on the terms of the lease and as we're tied then thats how it goes - or something similar - is far more relevant! The PIRRS website does list the last few years work done by the panel members both for and against the pubco's, and the tenant(ME) can choose who he wants. I'm pretty sure that I'm going down this routs starting tomorrow, we've rejected Punch's offer and they've rejected ours. I'm quite happy to allow the MA and the BII to document the case and publish it if they want to? There is no confidentiality agreement in place. It would be helpful for all tied tenants to have an accurate picture of how the scheme pans out, either a genuine system for conflict resolution or merely a PubCo rubber stamp! |

Hi Tara, Many Thanks for this I will be in touch ASAP, but believe it or not my wife has just been hospitalized with Pleuresy(sp?) so am slightly stressed at the minute! Paul Crooks from Punch is in agrement to using PIRRS so we should be fine. Thank Neil for me please, I'll chexk out the website today, and am reading the article today about it as soon as I've sent this! Michael |
