RE: West looks to Cherie Blair for smoke ban appeal According to the way this law has been written it is up to the licensee to stop people smoking but it doesn't state exactly how this should be done when the main priority is serving the few customers they have left in an establishment. The police aren't interested and the anti's are running round gleefully 'grassing' anyone & everyone up to the EHO's. Why can't the EHO's be called out to eject these heinous criminals-landlords have enough to do! This post replies to this thread |

RE: West looks to Cherie Blair for smoke ban appeal Yes we were in court yesterday and Dave West did get fined but that is not the whole story. As usual Westminster CC were their sual amateur selves. We had a very very biased magistrate who seemed on very good terms with the council(well he would be in westminster court wouldn't he!) Dave was fined for both dates when in actual fact he was only charged with the 4th Aug and not the 10th. The charges were dropped against Mark Fraher but the poor old magistrate got confused in his eagerness to please the powers that be and got carried away. He ignored the fact that it immerged that the undercover operatives (a right motley crew of kids who didn't look old enough to drink) were under the influence of alcohol, 3 bottles of wine and LARGE VODKA AND LEMONADES while on duty,well enough to lose your driving licence! did not cloud their judgement according to the magistrate because they had eaten a meal (at taxpayers expense!!) So remember that you had eaten if you ever get charged with drunk driving. The night in question at our retaurant people were smoking our Ecigarettes but they were too drunk to notice the difference. When Dave and I 'SMOKED' a ecigarette and cigar in court the magistrate fell off his perch shouting "put those out this minute" we carried on smoking them to prove our case that if he thought they were cigarettes then so did the drunks but he still found Dave guilty!!! RE: West looks to Cherie Blair for smoke ban appeal Harry nice to get the detail of what went on rather than relying on scant detail from the media.
Just goes to show the disproportionate amount of time and effort put into prosecutions connected with the smoking ban. Who says it's not politically motivated. Wish the authorities put as much zeal into catching real criminals and bringing them to book.
