QI would like to increase the number of fruit machines in my pub as they are proving to be lucrative. Do I have to apply for a transfer of the licence to be able to get a new section 34 permit?

AAn application for a section 34 permit can be made at any time and it is not necessary for a transfer application to be lodged at the same time. On the new application you would need to indicate how many machines you would like to have in the premises. When the application goes before the court you should be well prepared to deal with questions from the licensing justices. Ideally you should have figures showing how often the machines you already have are played and, for example, the average time that each person spends playing the machines. If you lease the machines from a company, the lease company should be able to provide this. It is also helpful if you can tell the court that you have people queuing to use the machines, if this is the case. Finally, it is a good idea to have a plan showing the location of both the machines already in place and the proposed machines. The licensing justices are conscious that AWP's should be positioned in such a way that they do not cause an obstruction.File under: 8 Betting and gaming. March 12 2001
