Paul Mildenstein, chief executive of pub funding specialist Liberis, explains the crucial legal tips when starting out as a publican.
  1. Get to know the Licensing Act 2003. Failure to do this will put your pub at risk. Ultimately, it’s your responsibility to ensure that your business and your employees comply with the law.
  2. Be aware of other laws related to areas such as music, streaming live sports on TV, pub prices and food allergy labelling.
  3. TOP TIP:​ Prepare to the smallest of details, and as far in advance as you can, if buying or renting. Try to sign contracts towards the end of the month because this gives you more cash flow flexibility with suppliers.
  4. Make sure you have all necessary paperwork like Pay As You Earn (PAYE), work permits and contracts of employment. Make sure you know Transfer of Undertakings (Protection of Employment) (TUPE) laws.
  5. Get to know the local council departments such as licensing, environmental health and trading standards services and get to know any local by-laws. Talk to the outgoing landlord about these.
